Third-Party Sexual Harassment Protecting Employees. Fighting Back Against Injustice.

Third-Party Sexual Harassment in New York

Employee-Only Counsel for Third-Party Sexual Harassment in New York

Sexual harassment may come from someone outside your organization, such as a client, customer, vendor, contractor, patient, or guest. At Arcé Law Group, we represent New York employees in these matters, focusing on what the employer knew, what it could have done, and how it responded after receiving notice.

The pressure can be acute when the harasser controls an account, generates revenue, leaves tips, or influences a business relationship. An employer shouldn’t require an employee to tolerate sexual misconduct to protect a sale, contract, patient relationship, or customer experience.

Call (866) 426-7182 for a free, confidential consultation about harassment by a client or other third party.

How Harassment by a Non-Employee Can Occur

The person responsible doesn’t have to be your supervisor or coworker. Misconduct may occur at a worksite, client location, conference, business dinner, hotel, or healthcare facility. It may also happen through email, text messages, workplace platforms, or other work-related communications.

Examples of conduct that may warrant legal review include:

  • Repeated sexual comments, jokes, questions, or propositions from a customer
  • Unwanted touching or advances by a client, patient, or guest
  • Explicit images or messages sent by a vendor or contractor
  • Requests for sexual favors tied to tips, accounts, contracts, or business opportunities
  • Threats, intimidation, or continued misconduct that management permits after a complaint

Harassment can affect employees of any gender. It may involve sex, sexual orientation, gender identity, pregnancy, or another protected characteristic. A hostile work environment is a workplace affected by unwelcome discriminatory conduct, but the standard applied to a claim depends on the governing law and specific facts.

When New York Employers May Be Responsible

The New York State Human Rights Law recognizes that workplace harassment may involve clients, customers, and contractors. An employer’s potential responsibility can depend on what management knew or reasonably should have known, its ability to control the situation, and whether it took appropriate corrective action.

Relevant facts include whether management investigated, separated the employee from the harasser, restricted the third party’s access, contacted another company involved, or allowed the conduct to continue. A written policy alone doesn’t establish that the response was appropriate.

Workers may also be protected by the New York City Human Rights Law when the matter falls within its coverage, as well as by federal law. Possible filing routes include the New York State Division of Human Rights, the New York City Commission on Human Rights, the Equal Employment Opportunity Commission, and state or federal court. Available forums and filing periods vary, so deadlines require an individual review.

Retaliation may become a separate issue if an employer responds to a complaint with termination, demotion, reduced hours, schedule changes, unfavorable assignments, discipline, or exclusion. Reporting misconduct internally isn’t the same as filing an agency charge or lawsuit, and an internal complaint doesn’t necessarily preserve every legal deadline.

The best decision of my life was to walk through the doors of the Arce Law Group. There is so much to say and not enough time or characters to fully describe my satisfaction, but overall it was a life changing experience. Christine, Bryan, and Cayetana treated me like I was family. They were open, honest, empathetic, and extremely supportive. Truly a dream team. They were sweet and authentically caring to the point that I never felt alone. Their attention to detail was on point throughout the entire process, and I got the results that I was hoping for. They exceeded my expectations by going above and beyond to advocate for me. I wish I could give them more than 5 stars because the way they championed on my behalf was out of this world. I would not hesitate to refer their services.

Employee-Only Employment Counsel Since 2011

We represent employees, never employers, in workplace disputes. Since opening in 2011, we’ve handled thousands of employment cases and secured millions in verdicts and settlements. Past results don’t guarantee a future outcome, but they reflect the scope of our employee-side work.

Attorney Bryan Arce worked in the hospitality industry for 12 years before entering law, giving him firsthand insight into client-facing workplaces. He also served as a judicial intern at the Equal Employment Opportunity Commission. Our attorneys are admitted in New York and multiple federal courts, including the Southern, Eastern, and Northern Districts of New York.

What Happens After You Contact Us

During a free, confidential consultation, we review the non-employee’s identity and conduct, the employer’s knowledge and response, internal complaints, available evidence, employment consequences, and your goals. We then explain which options may fit the facts and applicable law.

Depending on the circumstances, the process may involve:

  • Preserving messages, complaints, schedules, and other relevant records
  • Evaluating harassment, retaliation, discrimination, and related employment claims
  • Preparing a charge for an appropriate government agency
  • Negotiating with the employer or another responsible party
  • Pursuing a claim in state or federal court when warranted

We handle matters before the Equal Employment Opportunity Commission and the New York State Division of Human Rights, along with litigation in state and federal courts. We work on a contingency-fee basis, so you don’t pay legal fees unless we secure a financial settlement or verdict for you. Our clients range from entry-level employees to C-suite executives.
